Abstract
In the framework of transparency and access to information there are several problems related to the omission of the authorities to issue information requests
when there is a case related to serious human rights violations, one of the main problems derives from the lack of guidelines or references to interpret the term
'serious human rights violations' which is essential to classify this information that is accessible under this
category, However, this situation is aggravated when the authority incurs in discretionary acts and interprets this term depending on the specific case, affecting the rights of access to justice and to information by choosing
to omit information. For this reason, this paper will focus on analyzing the existing problem.
