Abstract

In Mexico, the interpretation of the human rights of older
adults must be systematically built on the principles of dignity,
the right to equality and non-discrimination based on
gender and age. The foregoing, since, due to their age and
state of vulnerability, they require reinforced protection by
the State to safeguard their interests and rights against
any act that violates or transgresses them. The casuistry
as a method of dispute resolution provided for in the Contradiction
of thesis 293/2011, imposed that in response to
different realities, different solutions must also be set; allowing
to set the criteria that judges must meet when resolving
conflicts related to older people; since, since they
are not a homogeneous group, such as, for example, minors,
older adults do not enjoy a presumption of need. Thus, the
present study aims to describe the evolution from which
the law regarding older adults in the constitutional State is
built, taking as reference two elements: jurisprudence and
direct protection in review 1754/2015.
